Why strong claims stall
The problem is often not the veteran. It is the gap in the record.
A condition may be serious and still be denied when VA does not find the required connection between current disability and military service. Records may be incomplete, an examination may not address the right facts, or lay evidence may not have been developed.
Decision letters can also be difficult to translate into an action plan. The reason for denial, the favorable findings, the evidence considered, and the selected review lane all matter.
Veterans and families should not have to guess what the agency needs next. A useful strategy begins with the actual decision and works backward from the missing element.
Common issues in a VA disability matter
- Evidence of a current diagnosed condition
- Evidence of an in-service event, injury, illness, or exposure
- Medical or factual support connecting the two
- Severity evidence for the correct disability evaluation
- Secondary conditions and changes over time
The C&P exam is evidence
A Compensation and Pension examination can strongly affect the claim. Be accurate and specific about onset, frequency, severity, functional impact, and flare-ups. Do not minimize a bad day or exaggerate a good one; explain the range honestly.
